Bizman Sue NDLEA Boss, RCCG Others Over Ownership Of Land

A Lagos based businessmen, Mallam Sadiq Eldau has dragged the Chairman of the National Drug Law Enforcement Agency (NDLEA), Col. Muhammad Mustapha Abdallah (Rtd) and four others before the Lagos State High Court, Igbosere over disputes over the ownership of a plot of land located in the Lekki area of the state.
Others respondents in the suit are: Alhaji Aboki Abdullahi, Innocent Achi, the Lagos State Registrar of titles, the Lagos State Land Bureau Services and Incorporated Trustee of the Redeemed Christian Church of God (RCCG ).
All the parties are currently in a legal battle before Justice Sherifat Solebo ownership of a plot .
According to the claimant, Eldau in his amended statement of claim before the court, the NDLEA boss, who is the allottee of the property lying at Block 114, Plot 1, Lekki Scheme 1, Victoria Island, sold the land to him through his agent which is the second respondent in the suit, Abdullahi.
While Achi and RCCG who are the third and fifth respondents in the suit respectively were persons whose interest rivals the interest of the claimant on ownership of the land.
The businessman alleged that sometimes in 2005, the second respondent, Abdullahi approached him with an offer to sell the property which is the subject matter of the suit, and he was informed that the NDLEA boss who is the allottee of the land was late and he was survived by his widow and one Mrs. Maria Abdallah.
The claimant also averred that he was informed by the second respondent that the said Mrs. Maria Abdallah by a power of attorney dated March 22, 2004, authorised the second respondent to sell the land on her behalf and the sum of 35 million naira was agreed as selling price, which the claimant allegedly paid and a Deed of Assignment was prepared by the agent as evidence of the transaction.
Upon that, the businessman averred that he invested heavily on the land by putting it in proper shape, securing it and also applying for the Certificate of Occupancy ( C of O ) .
Eldau claimed that since 2005 that he brought the land from the agent, he had no issue with the property until sometime in 2009, when the third respondent appeared to claim ownership of the land.
He averred that it was Achi who informed him that the NDLEA boss was not dead and was the one who sold the land to him. The matter was later reported at the police station, where all the interested parties met except the agent.
The businessman alleged that the ownership of the land was yet to be resolved when the NDLEA boss sold the land again to RCCG.
However the NDLEA boss in his statement of defence denied some of the averment of the claimant, he stated that he never instructed the agent (Abdullahi ) to sell the property on his behalf nor did he gave the agent title documents.
He claimed that it was at the police station that he got to know about the falsified probate paper used by the agent to sell the land.
The NDLEA boss further alleged that one Mrs. Maria Abdallah who authorised the sale of the land, is the wife of the agent.
The court has however, adjourned the suit till October 18 for further hearing.
